Negligence is the failure to use ordinary care, stated in Civil Code section 1714. Comparative fault reduces a recovery by the injured person's own share of responsibility rather than ending it, under Li v. Yellow Cab Co. The statute of limitations is the deadline to file suit, two years here under Code of Civil Procedure section 335.1.

Where a San Bernardino case is filed

Civil matters for the city are handled by the Civil Division of the San Bernardino District, 247 West Third Street, San Bernardino 92415-0210, on the court's own locations page. San Bernardino County is the largest county by area in the contiguous United States, and its courthouses are spread accordingly, from Rancho Cucamonga and Fontana to Victorville, Barstow, Big Bear, Joshua Tree and Needles. We have not verified how the court assigns civil filings among those districts, so if your crash happened in Fontana or Rancho Cucamonga, confirm the location with the court.

What makes a San Bernardino case different

Motorcycles. The California Office of Traffic Safety ranked San Bernardino 3 of 62 comparably sized cities for motorcycle crashes in 2023, with 90 riders killed or injured in a city of 222,571. It ranked San Bernardino County 5 of 58 California counties with 870 motorcycle victims. Rank 1 is the worst. A defense adjuster in this county opens a rider's file with a speed theory already formed.

Freight. Interstate 10 runs east toward Arizona, Interstate 15 north through the Cajon Pass, and Interstate 215 south toward Riverside, and they meet here. The CHP San Bernardino Area writes that its officers "encounter some of the most heavily congested roads in the nation on Interstates 10, 15, 215, and State Route 210." It adds that "an average of 160,000 vehicles travel on Interstate 15 on any given day" through the pass. Commercial vehicle cases here are routine rather than exceptional.

Pedestrians on wide arterials. Rank 10 of 62 in 2023, with 104 people struck on foot. Base Line Street, Highland Avenue, Waterman Avenue and Mount Vernon Avenue are long, wide and fast, with long gaps between signals. That geometry produces the crash that an insurer describes as a person stepping out, and that a scene reconstruction usually describes differently.

How dangerous are San Bernardino's roads?

The California Office of Traffic Safety ranks each city against others of similar size, using crash data, state population estimates and daily vehicle miles traveled. San Bernardino sits in group B, 62 cities, with a 2023 population of 222,571 and 1,980,980 daily vehicle miles traveled. Rank 1 is the worst in the group, so 3 of 62 for motorcycles and 8 of 62 composite are both bad results.

One caveat belongs with those totals. The rankings count crashes inside incorporated cities, including state highways within city limits that share jurisdiction with the California Highway Patrol. The agency states that "if a crash report is taken by the CHP on a road with shared jurisdiction, it does not count against the city." In a city where three interstates meet, that exclusion removes a large part of the real picture.

Where a San Bernardino ambulance takes you

A serious injury is not treated in San Bernardino. The city's hospitals are St. Bernardine Medical Center, 2101 N Waterman Avenue, 342 beds, and Community Hospital of San Bernardino, 1805 Medical Center Drive, 185 beds, and neither is a designated trauma center. Two designated centers sit within about five miles. Arrowhead Regional Medical Center, 400 N Pepper Avenue in Colton, has 366 beds. Loma Linda University Medical Center, 11234 Anderson Street, has 320 beds, with Loma Linda University Children's Hospital beside it.

The designation itself needs care. The California EMS Authority list updated October 22, 2025 shows Arrowhead Regional as Level I and Loma Linda as Level I adult and Level I pediatric. A 2020 Riverside County EMS Agency plan, describing its neighbor, recorded San Bernardino County as having one adult and pediatric Level I center and one adult Level II center that also runs a burn center. We cite the state list, and the county EMS agency is the body that settles it. What matters to your claim is that the treating hospital holds the records, sends the bills, and may assert a lien, a legal claim on your settlement for the cost of care.

Hurt on the 215 in San Bernardino?

Caltrans' current published annual average daily traffic shows Interstate 215 at 216,000 vehicles a day at Orange Show Road, 203,000 at Inland Center Drive and 197,000 at Mill Street, and Interstate 10 at 207,000 at Waterman Avenue. The two meet at Colton at 180,000 to 216,000 depending on the direction. The surface network is a mile grid of wide arterials: Base Line Street, Highland, Waterman and Mount Vernon Avenues, E Street and Hospitality Lane. They carry local traffic and freight off the interstates, which is why a pedestrian case here turns on lighting, crossing distance and signal timing.

Who has your San Bernardino crash report

The CHP San Bernardino Area office states that it has "primary responsibility for all traffic enforcement and traffic collision investigations which occur on freeways, state highways and unincorporated areas." It covers San Bernardino, Rialto, Colton, Fontana, Grand Terrace, Loma Linda, Redlands and Yucaipa. The freeway file is therefore a CHP file even though the crash happened inside the city. The report drives the adjuster's first decision on liability, so the request goes to the right agency the first time.

When a San Bernardino case is different

• The crash was in another district. This county runs courthouses from Fontana to Needles, and we have not verified how civil filings are assigned between them. Confirm with the court rather than assuming West Third Street.
• A commercial carrier is involved. Driver logs, inspection records and maintenance files have to be demanded in writing before they cycle out. See our post on the truck accident evidence preservation letter.
