After a Ventura injury

We represent people hurt in the City of Ventura, legally San Buenaventura, and the families of people killed there. A claim here turns on where the case is filed, the deadlines, what the state's crash data says about riding and walking here, where you are treated, and who writes the report.

Two names cause most of the confusion. The City of Ventura and the County of Ventura are different defendants, and a claim against the wrong one uses up a six month clock. If your crash happened in Oxnard, Camarillo or Ojai, the courthouse is the same and the city is not.

The court's own Hall of Justice page lists the case types heard there as appeals, civil, criminal, domestic violence, family law, small claims and traffic. Ventura County concentrates its civil work in that one building, so unlimited civil, limited civil and small claims all point to the same address on South Victoria Avenue.

Local factors in Ventura cases

One courthouse is a clear answer. These four situations complicate it.

  • The crash was on the 101, the 33 or the 126. Those are CHP roads. The report comes from the CHP Ventura Area, and it will not count in the city's crash statistics.
  • It happened in Oxnard, Camarillo, Santa Paula or Ojai. Same courthouse, different city, different police department, and a different public entity if a government defendant is involved.
  • You are suing over a road or a public vehicle. Decide first whether the defendant is the City of San Buenaventura or the County of Ventura. The six month claim goes to one of them, not both by default.
  • The injury needs Level I care. There is none in Ventura County. A transfer to Los Angeles County means a second set of records, a second billing department and often a second lien.

Bicycle and motorcycle crashes in Ventura

Bicycles and motorcycles define this city's injury profile. In 2023 Ventura recorded 70 bicycle victims and 40 motorcycle victims, ranking 5 of 62 and 6 of 62 among cities of similar size, and 3 of 62 for bicyclists under 15. Year round riding weather and a coastal route explain most of it. In a bicycle case the fight is usually the same one: whether the rider belonged in the lane. The statutes say the rider did, and our bicycle accident page works through each of them.

The coast corridor is the second pattern. West of the city the 101, the beach, the railroad and a bike path share a narrow shelf between the hills and the water. Volume on the freeway drops by half between Johnson Drive and the Santa Barbara county line. Mixed traffic in a narrow corridor produces the kind of case where a few feet of pavement decides fault.

We get you treated first and deal with the insurer second. The first offer is a negotiating position, not a valuation. On a bicycle or motorcycle file we also get the bike, the helmet and the clothing preserved before anyone throws them away, because they are physical evidence of the impact.

Ventura crash data

The California Office of Traffic Safety ranks cities using crash data, Department of Finance population estimates and Caltrans daily vehicle miles traveled, comparing each city only against cities of similar size. Rank 1 is the worst. Ventura is in population group B, with 108,361 residents and 940,010 daily vehicle miles traveled in 2023.

Rank 4 of 62 for total fatal and injury in a city of 108,000 is a serious number, and the vulnerable road user rows underneath it are worse. Thirteen children were hurt on bicycles here in one year. Source: OTS 2023 rankings for Ventura.

One caveat, from OTS itself: if a crash report is taken by the CHP on a road with shared jurisdiction, it does not count against the city. The 101 runs the length of Ventura and the CHP takes those reports, so this table understates what happens inside the city limits.

Hospitals nearby

Ventura County Medical Center, 300 Hillmont Avenue, is the county hospital and a Level II trauma center with 180 licensed beds. Community Memorial Hospital Ventura, 147 N Brent Street, adds 250 beds. Two acute hospitals and 430 beds between them in a city of 108,000 is a strong ratio, and it is why so much of the county's trauma comes here. The trauma designation is from the California EMS Authority list updated October 22, 2025, and the bed counts from the state licensed facility file.

There is no Level I trauma center anywhere in Ventura County. The nearest are in Los Angeles County. For the most severe injuries that means a transfer out of the county, which shows up in the claim as a second set of records, a second set of bills and a second lien. A lien is a hospital's or insurer's right to be repaid out of your settlement, and unresolved liens are a common reason a settled case takes months to pay.

Crashes on the 101 through Ventura

These are the current published counts from the Caltrans traffic census dataset. Note the drop from east to west.

State Route 33 climbs north into the Ojai Valley and State Route 126 runs east toward Santa Clarita. On surface streets the pattern is Main Street through downtown, Thompson Boulevard, Victoria Avenue, Telegraph Road and Harbor Boulevard along the beachfront, with the pier, the harbor and the county fairgrounds adding visitor traffic in season. For a freeway crash, our guide to freeway accidents covers how those files differ.

The CHP Ventura Area states that it patrols approximately 175 miles of freeway, including state routes, and 542 miles of unincorporated roadway within a 1,843 square mile territory. That territory covers Ventura, Oxnard, Camarillo, Santa Paula, Ojai and surrounding unincorporated areas, with Pacific Coast Highway and US 101 as its major corridors. Getting the right report from the right agency in the first week matters, because it is the document the adjuster reads before anything you send.

Next steps

Our headquarters are in Tarzana, about 48 miles down the 101. We have no Ventura County office. We travel, we take the first meeting by phone or video, and we handle the recorded statement request.

  1. 1
    Treatment first

We get you in front of the right doctor, often at Ventura County Medical Center or Community Memorial, and keep the file behind your recovery.

  2. 2
    The report and the evidence

We pull the police or CHP report, identify every insurer, and preserve the vehicle, the bicycle and the helmet before anything is discarded.

  3. 3
    The demand

A demand is the written package that values the claim: records, bills, wage loss and what the injury took from you.

  4. 4
    Negotiation, then filing

If the number is wrong, we file at the Hall of Justice on South Victoria Avenue and keep negotiating.

The deeper law sits on our Los Angeles pages: bicycle accident lawyer, motorcycle accident lawyer, car accident lawyer, pedestrian accident lawyer and wrongful death lawyer. If a driver passed too close or opened a door into your lane, read our post on the three foot law and dooring. Nearby we also serve Oxnard, Thousand Oaks and Santa Barbara, and the full list is on our locations page.

Questions about Ventura cases

Where will my Ventura injury case be filed?
At the Hall of Justice, 800 South Victoria Avenue, Ventura 93009, in your own city. Ventura County runs its civil work out of that single building, and the court's location page lists civil and small claims among the case types heard there. A Ventura injury case is filed and heard where it happened, which is not true of most California cities.
How long do I have to file a claim after a crash in Ventura?
Two years from the injury against a private driver or business, under Code of Civil Procedure section 335.1. If a public entity is involved, the City of San Buenaventura, Ventura County, a school district or a transit agency, you have six months to present a written claim under Government Code section 911.2. After a written rejection, you have six months to sue under section 945.6.
Is Ventura dangerous for cyclists?
By the state's measure, yes. In the 2023 Office of Traffic Safety rankings Ventura is 5 of 62 for bicyclists, with 70 people killed or injured, and 3 of 62 for bicyclists under 15, with 13 children. Rank 1 is the worst rate among cities of similar size. Ventura County as a whole also ranks high for cycling injuries.
Who investigates a crash on the 101 in Ventura?
The California Highway Patrol, Ventura Area, at 4656 Valentine Road, Ventura 93003. The CHP states that the Area patrols about 175 miles of freeway and 542 miles of unincorporated roadway across a 1,843 square mile territory that includes Ventura, Oxnard, Camarillo, Santa Paula and Ojai. A freeway crash produces a CHP report, not a Ventura Police Department report.
Which hospital will I be taken to after a serious crash in Ventura?
Ventura County Medical Center at 300 Hillmont Avenue, a Level II trauma center with 180 licensed beds and the county hospital. Community Memorial Hospital Ventura on North Brent Street adds 250 beds. There is no Level I trauma center anywhere in Ventura County, so the most severe injuries are moved to a Los Angeles County trauma center after stabilization.
Am I suing the city or the county?
It depends on who owned or controlled the thing that hurt you. The City of San Buenaventura and the County of Ventura are separate public entities with separate claim procedures, and each gets six months under Government Code section 911.2. A city street, a county road and a state highway can be within a mile of each other here, so tell us the cross streets and we will identify the right entity.
Do I have to come to your office?
No. Our headquarters are in Tarzana, about 48 miles from Ventura down the 101, and we have no office in Ventura County. We handle the first conversation by phone or video, we come to you when meeting in person matters, and nothing about the case requires you to drive to the Valley while you are hurt.
What does it cost to hire you for a Ventura case?
Nothing up front. We work on a contingency fee, which means our fee is a percentage of the recovery set in the written fee agreement. If there is no recovery, you owe no fee and no case costs. The case review itself is free, and you are under no obligation after it.
