How you are paid

The day you went back is not counted. Leave the return date blank if you are still off work; the count then runs through today. Weekends are skipped, holidays are not.

Optional. Regular overtime you would have worked, priced at one and a half times your hourly rate.

Days the absence was covered by paid leave. Leave you were forced to use is still a loss, because you no longer have it. Days taken later for appointments count too.

Leave you used is still a loss

Sick days and vacation days spent on an injury are gone, and you would have had them otherwise. California treats earned vacation as wages under Labor Code 227.3, so the days stay in the loss even though your paycheck did not drop. Ask HR for a statement of which days were paid from leave.

Can I claim lost wages if I used sick or vacation time?
Yes. Leave you were forced to use because of the injury is a loss even though your paycheck did not drop, because you no longer have those days. Enter them in the calculator and they stay in the total. Keep the HR record showing which days were paid from leave.
How do I calculate lost wages if I am self-employed?
Use the income you would have earned in the missed period, shown by the prior months' invoices, bank deposits, or tax returns, rather than an hourly rate. The salary option is a rough stand-in if you enter your annual net income, but the proof is the before and after comparison in your own records.
Does a lost wages claim include future lost earnings?
Not in this calculator. Wages lost to date are counted from your pay records. Future lost earnings, and loss of earning capacity when you cannot return to the same work, are separate claims, usually proved with a vocational expert and an economist. Tell us early if that is you.
