Medical liens and health plan reimbursement claims are often reduced before disbursement, and that negotiation is part of the work on a case. The fee percentage does not move: it is fixed by the written fee agreement, which must state it under Business and Professions Code 6147.

What comes out of a personal injury settlement before I am paid?
The attorney fee at the percentage in the written fee agreement, the case costs the firm advanced, any medical liens or health plan reimbursement claims, and anything else owed against the recovery, such as a loan taken against the case. What is left is disbursed to you with a written accounting of every line.
Is the attorney fee calculated before or after the liens are paid?
The fee is a percentage of the gross recovery, so it is calculated first. Liens are paid from what remains, and they are often reduced by negotiation before that happens, which is why the lien line is usually the one that moves in your favor.
Are medical liens negotiable?
Usually. Health plans, hospitals, and providers treating on a lien often accept less than the billed amount once they see the fee, the costs, and the share of the recovery that would otherwise reach you. The Hospital Lien Act, Civil Code 3045.1 and the sections that follow it, also limits what a hospital can take from a recovery. Other reductions are negotiated case by case.
