Hurt in San Diego? What happens now

Negligence is the failure to use ordinary care, stated in Civil Code section 1714. Comparative fault reduces your recovery by your own share of responsibility rather than ending it, under Li v. Yellow Cab Co. The statute of limitations is the deadline to file suit, and here it is two years.

Where a San Diego case is filed

San Diego Superior Court splits its work by building, and the split is not obvious from the street. Civil litigation happens at the Hall of Justice, 330 West Broadway, which the court describes as holding its Civil Independent Calendar courtrooms, the Civil Business Office and the Small Claims Business Office. The Central Courthouse at 1100 Union Street takes criminal, probate, family and appeals.

What makes a San Diego case different

Motorcycles are the number that stands out. The California Office of Traffic Safety counted 349 motorcycle victims in the city in 2023 and ranked San Diego 4 of 15 among the state's largest cities, where rank 1 is the worst. San Diego County ranks 1 of 58 counties for motorcycles, with 1,693 people killed or injured. No county in California posted a worse rate.

The border sits at the end of two freeways. I-5 and I-805 converge at San Ysidro and SR 905 carries commercial traffic east to Otay Mesa. Caltrans' current published annual average daily traffic shows 61,000 vehicles a day on I-5 at the international boundary and I-805 climbing from 76,000 to 155,000 at the SR 905 junction. That district mixes unfamiliar drivers, heavy trucks and people on foot.

San Diego is where the county's serious injuries end up. Every adult trauma center in San Diego County except Palomar Medical Center in Escondido is inside these city limits. A crash in Chula Vista or Carlsbad still produces records, bills and treating doctors here.

How dangerous are San Diego's roads?

The California Office of Traffic Safety ranks each city against others of similar size, using crash data, state population estimates and daily vehicle miles traveled. San Diego sits in group A, the 15 largest cities, with a 2023 population of 1,394,317 and 10,992,210 daily vehicle miles traveled. Rank 1 is the worst in the group, so 13 of 15 is a good result and 4 of 15 is not.

One caveat belongs with those totals. The rankings count crashes inside incorporated cities, including state highways within city limits that share jurisdiction with the California Highway Patrol. The agency states that "if a crash report is taken by the CHP on a road with shared jurisdiction, it does not count against the city." San Diego has more freeway inside it than almost any city in the state, so these figures understate the I-5, the I-805 and the I-8.

Where you are treated in San Diego

Five designated trauma centers sit inside the city on the California EMS Authority list updated October 22, 2025. Four are Level I: UC San Diego Hillcrest, Scripps Mercy, Scripps La Jolla and Rady Children's for a child, and Sharp Memorial on Frost Street is listed as Level II. Kaiser Foundation Hospital Zion on Zion Avenue, 319 beds, and UC San Diego Health East Campus on Alvarado Road, 302 beds, carry much of the rest.

Where you were treated decides more than most people expect. It sets who holds the records, which billing office answers, and whether a hospital or health plan asserts a lien, meaning a legal claim on your settlement for the cost of your care. Hurt on the 805 in San Diego?

The I-805 is the heaviest road in the city. Caltrans' current published annual average daily traffic shows 270,000 to 295,000 vehicles a day at Imperial Avenue and 232,500 to 270,000 at 47th Street. The I-5 carries 220,000 to 227,500 at Division and Main, and 185,000 to 217,500 near Mission Bay Drive. The City of San Diego runs a Vision Zero program with the stated goal of "Zero Traffic Related Fatalities and Severe Injuries" and a systemic safety approach, at sandiego.gov/vision-zero. That matters on surface streets, because a city with a safety program has usually studied the intersection where you were hit, and the study is discoverable.

Who has your San Diego crash report

The CHP San Diego Area office describes its territory as fourteen freeway systems covering over three hundred miles, taking in San Diego, Chula Vista, National City and Coronado. A freeway crash is a CHP report held by that office, not by the city. Getting the right report from the right agency is the first thing we do, because the collision report drives the adjuster's first decision on liability.

   A freeway crash is a CHP report from the Kearny Villa Road office and a street crash is a San Diego Police report. We request the correct one at once, because the report drives the adjuster's first call on liability.

   The demand, then filing

   A demand is the written package of records, bills, wage loss and liability proof that starts the negotiation. If the number comes back wrong, we file at the Hall of Justice inside the two year deadline.

When a San Diego case is different

• A public entity is involved. A city vehicle, a transit bus or a signal that was not working puts you on the six month clock, not the two year one. See our guide to being injured on government property.
• The crash was in the north county. The North County branch in Vista is a full service civil court with venue over most of northern San Diego County, so a Carlsbad or Oceanside case does not come downtown.
• The other driver carries the state minimum. One surgery passes it, and your own coverage becomes the case. See the California minimum limits and uninsured motorist claims.
• You were partly at fault. Pure comparative fault reduces damages by your percentage with no cutoff. A jury that values the harm at $100,000 and finds you 30 percent responsible enters judgment for $70,000.

Next steps after a San Diego crash

Suit is filed at the Hall of Justice on West Broadway, and you have two years to file it, or six months if a public entity is in it. Your treatment is almost certainly at one of the five trauma centers in the city, and your report comes from the San Diego Police Department or the CHP office on Kearny Villa Road.
