Questions about this tool

Do I have to report to the school before I call a lawyer?
No. A report to the police or the county child protection line does not go through the school, and you can make it yourself. School staff are mandated reporters under Penal Code 11166 and have their own duty to report what they know or reasonably suspect, but that duty is theirs, not a step you must complete first. You can call us at any point, before or after a report is made.
Is there a deadline for a claim about abuse of my child at school?
For abuse on or after January 1, 2024, Code of Civil Procedure 340.1 sets no time limit for a civil action. Earlier abuse follows older rules that generally allow a claim until the child turns 40, and we check the rule for your dates. A claim under section 340.1 against a public school district does not require the usual government claim first, under Government Code 905(m). The reports and records on this page matter sooner than any deadline.
What happens when I call?
A person listens. We ask how to reach you, whether it is safe to call back and when, and whether you are the parent or guardian. You can give any name, and you do not have to describe what happened. An attorney tells you what the law allows and what a case would involve, and nothing happens until you say so. No fee unless we recover. If there is no recovery, you owe no fee and no case costs.
