How many Irvine children are hit riding
Irvine is a safe city by the state's measure. The Office of Traffic Safety scores a city against others of its size, after weighting its counts for population and daily driving, and Irvine sits at or near the bottom of the risk table in almost every category. Twenty four children hurt on bicycles in one year, in the city that ranks last for alcohol involved crashes, is a fact about where children ride and what they cross rather than about reckless drivers in general. One caveat applies to all of these numbers: OTS states that where the California Highway Patrol writes the report on a road with shared jurisdiction, the crash does not count against the city, and Caltrans puts the I-5 at Culver Drive at 337,000 vehicles a day.
How Irvine riders get hit
Irvine is a master planned city, and its geometry is unusual enough to change the case. Jamboree, Culver, Barranca, Alton, Sand Canyon and Jeffrey are wide arterials with widely spaced signals, which produces high approach speeds between intersections and a separated bicycle network that has to cross them. The collision that follows is rarely a mystery. It is a driver turning right across a bike lane, a driver turning left across an oncoming rider, or a driver leaving a driveway into a path he never scanned.
Two Vehicle Code sections carry most of those cases. Section 21717 requires a driver turning right across a bicycle lane to drive into the lane before turning, which is the statute behind every right hook. Section 21801 requires a driver turning left to yield to anything close enough to be a hazard. Negligence per se is the rule that lets a jury presume negligence from a violated safety statute, and juries here get it as CACI No. 418.
Vehicle Code section 21206 allows local authorities to regulate the parking and operation of bicycles on pedestrian or bicycle facilities by ordinance, so long as the ordinance does not conflict with the Vehicle Code. Irvine has an extensive off street trail and path network beside its streets, and the rule that governs a rider on a separated path can differ from the rule on the roadway a few feet away. On the street itself, section 21200 is unchanged: a cyclist has the rights and the duties of a driver.
Your child's claim runs on two clocks
A child's claim runs on a different clock. The statute of limitations is the outside date for filing suit, and Code of Civil Procedure section 352(a) provides that if the person entitled to sue was under the age of majority when the cause of action accrued, the time of that disability is not part of the time limited for bringing the action. In plain terms, the two year clock does not run while the child is a minor.
The trap sits next to it. If the claim is against a public entity, the six month written claim under Government Code section 911.2 is not paused in the same way. Section 911.4 allows an application to present a late claim within a reasonable time not exceeding one year after accrual, and section 911.6 requires the board to grant that application in listed circumstances, including where the injured person was a minor. Families often learn about that sequence late. Where a road design, a signal or a trail crossing is part of the case, treat the six months as the real deadline.
Helmets are the other question every parent asks. Vehicle Code section 21212 requires a properly fitted helmet for riders and passengers under 18. Where one was not worn, the defense raises it as comparative fault, which reduces a recovery by the injured person's own share of responsibility rather than barring it. The argument reaches only the injuries a helmet would have prevented, so it says nothing about a broken wrist, a fractured femur, or the months of school missed.

Irvine has a large hospital cluster and no designated trauma center: Kaiser Irvine at 269 licensed beds, UCI Health Irvine at 144, Hoag Hospital Irvine at 120, per the California licensed facility file. Situations that change your Irvine claim
The crash was on the I-5 or the 405. Then the report is a California Highway Patrol report, from the Santa Ana Area office at 2031 E. Santa Clara Avenue or the Capistrano Area office in San Juan Capistrano, and the collision sits outside the city's OTS counts.
