What is different in Anaheim

Anaheim car crash? Start here

We represent drivers, passengers and the visitors who make up a large share of the traffic here, in any car crash inside Anaheim city limits. Rideshare crashes run on a different insurance statute and are on our Anaheim Uber and rideshare accident page. The general law of a California car accident claim is on our Los Angeles car accident lawyer page, and the wider local picture is on the Anaheim personal injury lawyer hub.

How dangerous is driving in Anaheim

The California Office of Traffic Safety never compares Anaheim to Los Angeles. It sorts cities into population groups and weights their crash counts against residents and miles driven before ranking them. Anaheim sits in group A, the state's largest cities, with a 2023 population of 342,054 and 3,255,930 daily vehicle miles traveled. Rank 1 is the worst.

OTS states that where a crash report is taken by the California Highway Patrol on a road with shared jurisdiction, the crash does not count against the city. Anaheim is crossed by the I-5, the 91 and the 57, so the table understates what happens inside the city's own borders.

Hit by a rental car or shuttle?

Anaheim traffic is not commuter traffic. The Harbor Boulevard and Katella Avenue interchanges on the I-5 are the Disneyland Resort exits, and the Katella and State College district holds Angel Stadium and the Honda Center. That produces drivers who have never seen these streets, hotel shuttles, event surges that empty at once, and a heavy rideshare load at the curb.

A visiting driver often has a rental car and an out of state policy, which changes who the adjuster is. A shuttle or a hotel van puts an employer in the case, with a commercial policy above the driver's own.

How fault is proved in Anaheim

Negligence is the failure to use the care a reasonably careful person would use. California states it in one sentence: Civil Code section 1714(a) makes everyone responsible for injury caused to another by want of ordinary care. The traffic statutes give that sentence content, and the two that decide most Anaheim files are Vehicle Code section 21703 on following too closely and section 22350, the basic speed law.

One more statute matters here because of Anaheim's freeway geometry. Vehicle Code section 21658(a) requires a vehicle to be driven as nearly as practical entirely within a single lane, and not to be moved from the lane until the movement can be made with reasonable safety. Where the 91 meets the 57 and traffic crosses four lanes in half a mile to make an exit, that section often decides the case. Negligence per se is the rule that lets a jury presume negligence from a violated safety statute, and Orange County juries get it as CACI No. 418.

Being partly at fault does not end a claim here. Pure comparative fault gives each person a percentage of responsibility and cuts the injured person's damages by that percentage, with no cutoff. A 20 percent share costs 20 percent. Our guide to Los Angeles freeway accidents covers how that argument runs when everyone was moving.

Your deadlines and your courthouse

Orange County does not spread civil filings across district courthouses the way Los Angeles County does. Every unlimited civil injury case from Anaheim goes to one building in Santa Ana. The court states the dividing line in its own words: if the amount of the dispute is $35,000 or less, the action is a limited civil case. Anything above it is unlimited civil, with full discovery.

Where you will be treated

Anaheim has the largest concentration of hospital beds in north Orange County and no designated trauma center. Kaiser Foundation Hospital Anaheim carries 262 licensed beds, AHMC Anaheim Regional 223 and West Anaheim Medical Center 167, per the California licensed facility file. A serious crash still leaves the city. Orange County has four designated trauma centers on the California EMS Authority list updated October 22, 2025, and the two that receive Anaheim patients are UCI Health Orange, 101 The City Drive South, listed as Level I adult and Level II pediatric, about four miles southeast, and Orange County Global Medical Center in Santa Ana, Level II.

That transfer matters to the paperwork as much as to the medicine. Two hospitals means two sets of records and often two liens, a lien being a right to be paid out of your settlement before you see any of it. We collect both sets early and negotiate them at the end. Our headquarters are in Tarzana, and you do not have to make the drive. Broadway, about 29 miles from Anaheim, roughly 41 minutes without traffic. The court, the treatment and the defendants are local. Our office is not, and the case runs by phone, text and email.

Four situations that change your Anaheim claim

The crash was on the 5, the 91 or the 57. Then the report is a California Highway Patrol report, not an Anaheim Police Department report. The CHP Westminster Area, 13200 Goldenwest Street, describes itself as patrolling the freeways close to Disneyland and Knott's Berry Farm, and the CHP Santa Ana Area, 2031 E. Santa Clara Avenue, patrols more than 225 miles of Orange County freeway.

A public entity was involved. A city vehicle, a transit bus or a defect in the road collapses the clock to six months under Government Code section 911.2, and a road claim runs under Government Code section 835, which requires notice in time to fix the condition.

The other driver carried the state minimum. Vehicle Code section 16056 set the floor at $30,000 for one person and $60,000 per crash on January 1, 2025. Policy limits are the ceiling an insurer will pay under that policy, and one ambulance ride and one MRI can pass $30,000. Your own uninsured and underinsured coverage is then the case, and our guide to uninsured and underinsured motorist claims walks the deadlines that come with it.

You were in an Uber or a Lyft. A different statute controls, and the coverage is far larger; see the Anaheim rideshare page. We handle the same claims next door in Santa Ana and across Orange County.

The insurer's first number is a negotiating position. In the rear-end case above, the first offer was $31,500 and the recovery was $1,250,000 after back surgery. Your own case turns on your records and the coverage available.

What to do after an Anaheim crash

You have two years to sue, six months if a public entity is in the case, and one courthouse in Santa Ana that will hear it. Value is decided by the medical record and the coverage. Tell us the crash date, the report number if one exists, and where you were treated, and we handle the recorded statement, the preservation letters and the deadline while you treat.

Questions about car accidents in Anaheim

Where will my Anaheim car accident case be filed?
At the Central Justice Center, 700 Civic Center Drive West, Santa Ana. Orange County keeps unlimited civil injury filings in that one building rather than spreading them across branch courthouses, and limited civil cases are heard there too. Complex matters go to the Civil Complex Center at 751 West Santa Ana Blvd. The court treats a dispute of $35,000 or less as limited civil.
How long do I have to bring a car accident claim in Anaheim?
Two years from the crash under Code of Civil Procedure section 335.1. If a public entity is involved, such as a city vehicle or a defect in the roadway, you must present a written claim within six months under Government Code section 911.2 and the lawsuit deadline is then measured from the rejection. A written report to police is due in 24 hours and form SR-1 to the DMV in 10 days.
Who investigates a car crash in Anaheim?
On city streets, the Anaheim Police Department. On the I-5, the 91 or the 57, the California Highway Patrol. The Westminster Area office at 13200 Goldenwest Street patrols the freeways nearest the resort, and the Santa Ana Area office at 2031 E. Santa Clara Avenue patrols more than 225 miles of Orange County freeway. Which agency wrote the report changes how you request it.
Which hospital treats a serious Anaheim crash injury?
There is no designated trauma center in Anaheim. Five hospitals in the city handle emergency care, including Kaiser Anaheim with 262 licensed beds and AHMC Anaheim Regional with 223. Trauma patients are taken to UCI Health Orange, listed by the California EMS Authority as Level I adult, about four miles southeast, or to Orange County Global Medical Center in Santa Ana, listed as Level II.
What if I was partly at fault for the crash?
California uses pure comparative fault, so your recovery is reduced by your percentage of responsibility rather than barred by it. A 20 percent share costs 20 percent. Adjusters routinely propose a percentage in the first phone call, before the report is even available. The crash report, the vehicle damage and the independent witnesses usually settle the question.
What if the driver who hit me was visiting from out of state?
The claim still runs under California law, because the crash happened here. What changes is logistics: an out of state insurer, a rental agreement that may add a second policy, and a defendant who is hard to reach for a deposition. We ask for the rental contract and the declarations page early, because a visitor's coverage is often broader than the California minimum.
What is an Anaheim car accident case worth?
No average would mean anything, because the range is set by your injuries, your treatment, the wage loss and the coverage available. What drives the number is the diagnosis in the record, whether future care is documented by a treating physician, and whether more than one policy responds. Our case results page shows real recoveries with the insurer's first offer beside each.
Do I need to come to your office?
No. Our headquarters are in Tarzana, and you do not have to make the drive. If you are treating, we come to you. The court appearances are in Santa Ana, and those are ours to handle.
