Scene photographs taken in the first minutes settle fault arguments that would otherwise run for months. If you are hurt, call 911 first and let someone else hold the phone. If police tell you to move the cars, photograph them where they stopped before you do. Then work down this list.

Do not discuss fault, and do not say you are fine
An apology on its own is shielded by Evidence Code 1160, but a statement about what you did or did not see is an admission in the report. “I am being evaluated” is the answer to every question about how you feel. See a doctor the same day and name every part of your body that hurts.

Questions about crash scene checklist
Do I have to report a car accident to the police in California?
If anyone was hurt or killed, yes. Vehicle Code 20008 requires a written report to the CHP or the city police within 24 hours unless an officer took the report at the scene. Separately, Vehicle Code 16000 requires form SR-1 to the DMV within 10 days when anyone is injured or damage passes $1,000.
What if the other driver refuses to give me their insurance information?
Photograph their plate and their car, note the time and place, and tell the officer. Vehicle Code 16025 requires the exchange, and a refusal is itself worth recording. Your own uninsured motorist coverage may apply if they turn out to be uninsured.
Should I move my car after a crash?
If the cars can be driven and are blocking traffic, California law expects you to move them out of the lanes. Photograph them where they stopped first, from far enough back to show the lane markings, and then move them.
